These Terms of Service (the "Terms") form a binding agreement between you and the trader identified below in relation to your use of the waltru website (notanothertravelapp.com and related domains) and the waltru mobile application (together, the "Service"). Please read them carefully before using the Service.

These Terms are drafted for consumers habitually resident in the European Union and the European Economic Area. They implement the requirements of Directive 2011/83/EU on consumer rights, Directive (EU) 2019/770 on certain aspects concerning contracts for the supply of digital content and digital services, Directive 93/13/EEC on unfair terms in consumer contracts, Regulation (EU) 524/2013 on online dispute resolution, Regulation (EU) 2018/302 on geo-blocking, Regulation (EU) 2024/1689 (the "AI Act"), and Spanish Law 34/2002 (LSSI-CE) and Royal Legislative Decree 1/2007 (General Law for the Defence of Consumers and Users), as applicable.

Throughout these Terms, "we", "us" and "our" refer to the trader above; "you" and "your" refer to the person using the Service.

2. Eligibility

To use the Service you must be at least 14 years old (the age of digital consent in Spain under Article 7 LOPDGDD). If you are under 18, you confirm that your parent or legal guardian is aware of and consents to your use of the Service. You must also have the legal capacity to enter into a binding contract under the law of your country of residence. Certain paid features may require you to be 18 or older; this will be made clear at the point of purchase.

3. Your Account

To access certain features you must create an account using our authentication provider (Auth0). You agree to provide accurate and current information, to keep your credentials confidential, and to notify us promptly at waltru@notanothertravelapp.com if you suspect unauthorised access. You are responsible for activity carried out through your account, except to the extent that it results from our fault or from a security failure attributable to us. You may close your account at any time from within the App or by writing to us.

If the Service allows you to submit content (for example, trip notes, feedback or partner enquiries), you retain ownership of that content. You grant us a worldwide, non-exclusive, royalty-free, transferable licence to host, store, reproduce, adapt and display that content solely to the extent necessary to operate, improve and promote the Service and for the duration strictly required for those purposes. You are responsible for the content you submit and confirm that you hold the rights needed to grant this licence.

7. Third-Party Services and Content

The Service integrates with, or displays content from, third parties, including Google Maps Platform, Apple Maps (where applicable), transport operators, ticketing partners and cultural venues. Your use of those third-party services may be subject to their own terms, which we encourage you to review. We are not responsible for the accuracy, availability, pricing or conduct of third parties, except where mandatory consumer law provides otherwise.

Apple and Google App Stores. These Terms are concluded between you and us only, and not with Apple or Google. We, and not Apple or Google, are solely responsible for the App and its content. Apple and Google have no obligation to furnish any maintenance or support for the App. To the maximum extent permitted by applicable law, Apple and Google give no warranty in relation to the App; any claim relating to the App (including product liability, regulatory compliance and third-party intellectual-property claims) is our responsibility and not theirs. You represent that you are not located in a country subject to a relevant embargo and that you are not on a list of prohibited or restricted parties. Apple, Google and their subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

8. Purchases, Pricing and Payment

Some features of the Service are free; others require a one-off payment (for example, to unlock a city or a visit). This is not a subscription: there is no automatic renewal and no recurring charges. The applicable price is shown to you in your local currency, based on the country of your Apple or Google account, before you confirm your purchase, in accordance with Articles 60 and 97 of Royal Legislative Decree 1/2007. All prices include applicable VAT unless stated otherwise.

Payments are processed through the in-app-purchase systems of Apple and Google, managed via RevenueCat, Inc.. Only as a fallback, if the store's purchase system is unavailable, payment may be processed by Stripe Payments Europe, Ltd.; we do not operate our own payment page except in that contingency. When you pay through the App Store or Google Play, the terms of Apple or Google apply to the transaction and any refund request must in the first instance be raised with them.

9. Your Right of Withdrawal

If you are a consumer resident in the European Union, you have the right to withdraw from a purchase of digital content or a digital service within 14 calendar days of the date the contract is concluded, without giving any reason, in accordance with Articles 9 to 16 of Directive 2011/83/EU (Articles 102 to 108 of Royal Legislative Decree 1/2007).

To exercise this right, you must inform us at waltru@notanothertravelapp.com of your decision to withdraw by means of a clear statement. You may use the model withdrawal form reproduced at the end of these Terms, but it is not mandatory. We will reimburse you within 14 days of receiving your withdrawal request using the same means of payment you used for the original transaction.

Important exception — digital content and digital services. Under Article 16(m) and (n) of Directive 2011/83/EU (Article 103(m) and (n) of RDL 1/2007), your right of withdrawal is lost if performance of the Service has already begun and you have given (i) your prior express consent to start performance during the 14-day withdrawal period and (ii) your acknowledgment that you will therefore lose your right of withdrawal. Where the purchase is made through the App Store or Google Play, you give this consent by confirming the purchase in the store's flow. Where the purchase is instead processed through the Stripe fallback, we will ask for your express consent and acknowledgment before starting performance.

10. Conformity of the Service and Our Liability to Consumers

In accordance with Directive (EU) 2019/770 and Articles 115 bis and following of Royal Legislative Decree 1/2007, we are liable to you for any lack of conformity of the digital service that exists at the time of supply and becomes apparent within two years of that supply. If a lack of conformity occurs, you are entitled, in this order, to have the Service brought into conformity, or, in the circumstances set out in the law, to a proportionate price reduction or termination of the contract.

11. Limitation of Liability

Nothing in these Terms limits or excludes our liability where such limitation or exclusion is prohibited by applicable law. In particular, we do not exclude or limit liability for:

For paid features, our aggregate liability in contract, tort (including negligence) or otherwise arising out of or in connection with these Terms is limited to the greater of (a) the amount you paid to us in the twelve (12) months preceding the event giving rise to the claim and (b) one hundred euros (€100). This cap does not apply to the liability we cannot limit under the previous paragraphs.

12. Changes to the Service and to These Terms

We may modify the Service — for example, to add, change or discontinue features — provided that such changes do not disproportionately reduce the functionality of paid features during the minimum period you have paid for, and in accordance with Article 19 of Directive (EU) 2019/770.

We may update these Terms to reflect changes to the Service, to our business, or to applicable law. Where changes are material we will notify you by email or through an in-App notice at least 30 days before they take effect. If you do not accept the new Terms, you may terminate the contract before they enter into force and, where you have paid for a period that extends beyond that date, obtain a pro-rata refund for the unused period.

13. Suspension and Termination

We may suspend or terminate your access to the Service, in whole or in part, with reasonable prior notice, if:

Urgent suspensions (e.g. security incidents, fraud, court orders) may take effect without prior notice. You may close your account or cancel your purchase at any time as set out in Sections 3 and 8. On termination, paid features will remain active until the end of the paid period unless the termination is for your serious breach.

14. Intellectual Property

All rights in the Service — including the waltru brand, software, interface, graphic design, original audio guides, original written content, databases of points of interest and the compilation of third-party data — belong to us or to our licensors and are protected under applicable intellectual property law.

Subject to your compliance with these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable licence to install the App on devices you own or control and to use the Service for your own personal, non-commercial travel purposes. All rights not expressly granted are reserved.

15. Force Majeure

Neither party is liable for a failure or delay in performing its obligations under these Terms caused by events beyond its reasonable control, including acts of God, natural disasters, epidemics, war, terrorism, civil unrest, strikes, failure of public networks or of third-party cloud services, or binding acts of public authorities. The affected party will notify the other as soon as reasonably possible and will resume performance once the event has ceased.

16. Data Protection

We process personal data in accordance with the GDPR and our Privacy Policy, which forms an integral part of these Terms. Our use of location data and AI services is described there in detail.

17. Complaints and Out-of-Court Dispute Resolution

If you are not satisfied with the Service, please contact us first at waltru@notanothertravelapp.com. We will acknowledge your complaint within 10 working days and aim to resolve it within a reasonable period.

As a consumer resident in the European Union you may also refer the dispute to the European Commission's Online Dispute Resolution platform available at https://ec.europa.eu/consumers/odr, in accordance with Article 14 of Regulation (EU) 524/2013.

18. Governing Law and Jurisdiction

These Terms and any dispute arising out of or in connection with them are governed by Spanish law, excluding its conflict-of-laws rules. Where you are a consumer habitually resident in another EU/EEA Member State, you continue to benefit from the mandatory consumer-protection provisions of your country of residence pursuant to Article 6 of Regulation (EC) 593/2008 (Rome I).

If you are a consumer, claims may be brought before the competent courts of your place of residence or those of the trader, at your choice (Article 18 of Regulation (EU) 1215/2012, Brussels I bis).

19. Geo-Blocking

We comply with Regulation (EU) 2018/302. We do not discriminate in access to the Service on the basis of your nationality, place of residence or place of establishment within the EU. However, the coverage and language of the Service may vary by city and by country, and we may decline to deliver certain services outside the cities where we operate.

The Service is directed at users in the European Union and the European Economic Area, and currently operates in selected cities (initially Barcelona). If you access the Service from outside the EU/EEA, you do so on your own initiative and are responsible for compliance with applicable local law.

20. Miscellaneous

Entire agreement. These Terms, together with the Privacy Policy and any purchase-specific terms shown at checkout, constitute the entire agreement between you and us in respect of the Service.

Assignment. You may not assign or transfer your rights under these Terms without our consent. We may assign our rights and obligations to an affiliate or to an acquirer of our business, provided your rights under these Terms are not diminished.

Severability. If any provision is held invalid or unenforceable, the remaining provisions remain in full force; the invalid provision will be replaced by a valid one that reflects as closely as possible the original intent.

No waiver. Our failure to enforce any right is not a waiver of that right.

Language. These Terms are made available in English and in Spanish. In case of discrepancy between versions, the Spanish version shall prevail for consumers resident in Spain; for consumers resident in other EU/EEA Member States, the English version shall prevail, subject to mandatory local-language rules.
